These general terms and conditions ("T&C") apply to all services of the Cari'Stay aparthotel (hereinafter "the Host"), located at Route du Port 23, 1568 Portalban. The term "Guest" refers to any person who has made a reservation.
01.Nature of the establishment
Cari'Stay is an aparthotel — a hospitality establishment composed of 11 independent, furnished and equipped studios, offering hotel services (24/7 check-in, cleaning, linens, reception) while guaranteeing the autonomy of an apartment.
Stays can be of any length: from a weekend to long-term.
02.Application and scope
These T&C apply to any reservation made via cari-stay.ch or any other channel operated by the Host (phone, partner agencies, third-party platforms).
Any contrary or supplementary condition emanating from the Guest is deemed not written unless expressly agreed in writing by the Host.
03.Reservation and contract formation
- · The studios offered constitute an invitation to offer. The Guest makes their reservation request online by selecting dates, number of travelers and filling out the form.
- · The contract is formed upon written confirmation by the Host, after verification of final availability and acceptance of payment.
- · The Host reserves the right to refuse any clearly abusive, suspicious or non-compliant reservation.
04.Use of the studio
- · Private residential use: each studio is intended exclusively for the personal accommodation of the Guest and travelers declared at booking. Subletting and any transfer to a third party are strictly prohibited.
- · Commercial use prohibited: any commercial use (filming, photo shoots, events, reception of clientele, etc.) is strictly prohibited.
- · Capacity: occupancy is strictly limited to the number of persons indicated at booking.
- · Quietness: parties and noisy events are strictly prohibited, with silence from 10:00 PM.
- · Smoking: strictly prohibited inside the studio. Cleaning fees from 300 CHF.
- · Pets: only admitted with express authorization from the Host at booking.
- · Liability: the Host declines all liability in case of theft, loss or accident. The Guest must be covered by personal civil liability insurance.
05.Prices, payment and taxes
- · Prices in Swiss francs (CHF), all taxes included.
- · City tax: mandatory, added per municipal rates in the canton of Fribourg (Delley-Portalban).
- · Full payment required at booking. Secured via Stripe (PCI-DSS Level 1).
- · Nominal invoice issued by email after stay, upon request.
06.Deposit and registration
- · Online registration via Duve is mandatory: identity validation, contract signature, security deposit if applicable.
- · Deposit: bank pre-authorization between 200 and 500 CHF, released if no damage.
- · Damages exceeding deposit billed in full to Guest.
07.Cancellation and modifications
Unless specific conditions at booking apply:
- · More than 30 days before arrival: free cancellation, full refund.
- · Between 14 and 29 days: 50% refund.
- · Less than 14 days: no refund.
- · No-show or early departure: no refund.
Date modifications possible subject to availability. One free modification per booking.
Swiss legal exception: Article 40b of the Swiss Code of Obligations: no right of revocation for tourist accommodation services.
08.Arrival and departure
- · Check-in: from 3:00 PM, autonomous via digital access (24h before). Host reachable 8 AM - 11 PM.
- · Check-out: before 11:00 AM. Late departure: 50 CHF per started hour.
- · Access instructions sent at latest 24h before arrival.
09.Immediate termination
The Host may terminate the contract with immediate effect and without refund in case of:
- · dangerous or disrespectful behavior;
- · noise nuisance despite warning;
- · unauthorized commercial use;
- · occupancy exceeding declared capacity;
- · undeclared animals;
- · smoking inside;
- · false declaration;
- · any behavior contrary to these T&C or Swiss laws.
10.Force majeure
No party liable for breach of obligations in case of force majeure under Swiss law. Host commits to offering postponement or equivalent credit.
11.Data protection
Personal data processing governed by our privacy policy (FADP & GDPR compliant).
12.Complaints and mediation
Complaints to contact@cari-stay.ch within 30 days of departure. Response within 15 working days.
Mediation via HotellerieSuisse or Swiss Tourism Ombudsman before judicial action.
13.Applicable law and jurisdiction
Governed by Swiss law.
Exclusive jurisdiction: Estavayer-le-Lac (Broye district, canton of Fribourg, Switzerland), subject to mandatory European consumer law provisions.
